Will of Deuel Rowley dated 30 Apr. 1821

Recorded September 1, 1841

In the name of God, Amen. I Deuel Rowley of the town of China in the County of Genesee & State of New York, being weak in body but of sound and perfect mind and memory (blessed be the Almighty God for the same) do make and publish this my last Will and Testament in manner and form following (that is to say)

First, I give and bequeath unto my beloved wife Anna Rowley the side and improvement of the one third of all my Estate during her natural life; I also give and bequeath unto Paulina Hochstrasser one dollar to be paid out of my personal property, likewise, I give and bequeath unto Alexander K. Hochstrasser one dollar also to be paid out of my personal property. I also give and bequeath unto my little daughter Susanna Rowley fifty dollars.

Lastly I give and bequeath unto my son Ira Rowley all that my messuage or tenement with the appurtenances situate lying and being in the town of China and in the county of Genesee together with all my Estate to hold to him the sd Ira Rowley his heirs and assigns forever, the side of the sd Anna Rowley: thirds reserved during her natural life.

I also will that my funeral expenses and other debts be paid out of my personal property and the remainder of all my personal property household furniture beds or beding after paying the usual sums of money to the said respective legatees I give and bequeath to my son Ira.

I hereby appoint Walter Hinckley sole executor of this my last will & testament, hereby revoking all former by me made. In witness whereof I have hereunto set my hand and seal this thirtieth day of April one thousand eight hundred and twenty one.

Wyoming County      ss: Be it remembered at a Surrogate Court held at the Surrogate office in Attica in and for the County of Wyoming on the first day of September in the year of our Lord one thousand eight hundred and forty one before Harvey Putnam, Surrogate of said county the last will and testament of Deuel Rowley late of the town of China in said county deceased of which the preceding record of a will is a true copy was admitted to be proved and recorded as a will of personal estate only after citation to the heirs and next of kin of the said deceased had been issued, served, statements made, filed according to law requiring them to appear before the said Surrogate to attend the proof of the said will, and after the making and filing the said citation with due proof of the service thereof in due form of law, the said will was produced in the said Surrogates court before the said Surrogate and the following disposition of the witnesses were therefrom taken for the purpose of having the same provide and recorded as a will of personal Estate in persuance of the statute in such case made and provided.

In the matter of proving the will
of Deuel Rowley deceased--     Wyoming county SS:
Roger G. Hinckley of the town of China in the county of Wyoming being duly sworn doth depose and say that he is well acquainted with the hand writing of Walter Hinckley, Mercy Hinckley and Walter Hinckley Junior and Deuel Rowley late of the town of China aforesaid; and this deponent further says that he has frequently seen the said Walter Hinckley, Mercy Hinckley, Walter Hinckley Junior and Deuel Rowley each of them write; and this deponent further saith that the said Walter Hinckley was on the thirtieth day of April one thousand eight hundred and twenty one a resident of the town of China aforesaid and that in the month of February 1838 in the town of Humphrey in the county of Cataraugus the said Walter Hinckley who is named executor in the will hereinafter mentioned died and departed this life; and this deponent further saith that the said Mercy Hinckley was on the thirtieth day of April one thousand eight hundred and twenty one a resident of the town of China aforesaid and was the wife of Walter Hinckley above named and the mother of this deponent and further that in the month of October 1827 at China aforesaid the said Mary Hinckley died and departed this life ; and this deponent further says that on the said thirtieth day of April one thousand eight hundred and twenty one the above named Walter Hinckley Junior was a resident of the town of China aforesaid and was a brother of this deponent and that on the thirteenth day of April 1828 the said Walter Hinckley Junior left and departed from the State of New York and that for four or five years last past he the said Walter Hinckley Junior has been and now is a resident of the township of Milan in the Republic of Texas and this deponent further says that he has no expectation, information or belief that said Walter Junior will return again to the State of New York, and that he has never returned to said State since he left and departed therefrom as aforesaid, and this deponent further saith the said Deuel Rowley did in the presence and hearing of this deponent acknowledge that he had subscribed his name at the end of the instrument which is now shown and exhibited to this deponent and which purports purports to be the last will and testament of the said Deuel Rowley and which bears date on the thirtieth day of April in the year of our Lord one thousand eight hundred and twenty one and this deponent further saith that the said testator did at the time of acknowledging his signature as aforesaid at the end of the said will declare the said instrument as subscribed and now exhibited to be his last will and testament and Mercy Hinckley and Walter Hinckley Junior then of China aforesaid and above named with their own proper hand within the view and observation of this deponent did thereupon subscribe their names at the end of the said will as attesting witnesses thereto in the presence and at the request of the said testator and this deponent further saith the name of Walter Hinckley subscribed at the end of the said instrument as attesting witness thereto is the genuine and proper signature of the said Walter Hinckley as this deponent believes and this deponent further saith that at the said time when the said testator acknowledged his signature to the said last will as aforesaid and at the time of the said Walter Hinckley, Mercy Hinckley and Walter Hinckley Junior subscribing their names as attesting witnesses thereto as aforesaid the said testator was of sound mind and memory and of full age to execute a will and was not under any restraint and that the said will now appears in all respects as when so executed without any alteration whatsoever, and this deponent further saith that the said Walter Hinckley whose name is subscribed as an attesting witness to the said will and who departed this life as aforesaid was the same Walter Hinckley who is named as executor in the said will and this deponent further says that after he had taken Letters of administration upon the estate of the said Walter Hinckley deceased and as this deponent believing sometime in the month of April 1838 when by virtue of that letter aforesaid he took into his possession the goods, chattels and credits of said deceased he found in the chest all of said deceased at his residence immediately before his decease in Yorkshire in the county of Cataraugus aforesaid the said instrument purporting to be the last will and testament of the said Deuel Rowley deceased and which was sealed up and endorsed Deuel Rowley’s will and testament and that the instrument now produced and offered for probate is the same instrument which was so found as aforesaid by this deponent and further this deponent saith that the said instrument was safely and securely kept by this deponent in his possession from that time until on the eighth day of July in the year of our Lord one thousand eight hundred and forty one when the said instrument was delivered by the wife of this deponent to Ira Rowley heir at law of said deceased and a devisee therein named for the purpose of presenting to the Surrogate of said county for probate as was alleged by him to this deponent, and further this deponent saith not.

American influence steadily became stronger and a revolt against the tyranny of the Mexican Government broke out in 1835. Houston’s decisive victory over the Mexican commander, Santa Anna, at San Jacinto in 1836, freed Texas. The country’s independence was recognized by the United States, Belgium, France, and Great Britain. In 1845 Texas was admitted into the Union as a State. In the matter of proving the will
of Deuel Rowley deceased      County of Wyoming SS: Ira Rowley of the town of China in the county aforesaid being duly sworn doth depose and say that on or about the eighth day of July in the year of our Lord one thousand eight hundred and forty one the said last will and testament was delivered to this deponent for the purpose of being presented to the Surrogate of said county for probate by Jane A. The wife of Roger Hinckley in whose possession the same had been from the month of April 1838 when it came to the hand of the said Roger G. as legal representative of Walter Hinckley deceased in whose hand the same was deposited at the time of its execution by Deuel Rowley the said testator as this deponent is informed and verily believes and that the instrument now produced and offered for probate is the same instrument which was ad delivered as aforesaid to this deponent and further this deponent saith that the said instrument was safely and securely kept by this deponent in his possession from that time until on the third day of August in the year of our Lord one thousand eight hundred and forty one when the said instrument was delivered by this deponent to Harvey Putnam Surrogate of said county for probate thereof.

Wyoming county SS: I Harvey Putnam Surrogate of said county do hereby certify the preceding to be a true record of the will of Deuel Rowley deceased and of the proceedings proofs and examination here and taken thereon an admitting the same to probate as a will of personal estate in possession of the Statue in such case made and provided and that all the same were recorded and examined the second day of September one thousand eight hundred and forty one.

Jacob Rowley, Will dated 28 June 1847

In the name of God Amen I Jacob Rowley of Plum Creek Township Armstrong County farmer being sick and weak in body but of perfect mind and memory and knowing the mortality of my body that it is appointed for all men to die I resign my soul to God who gave it and my body to the dust to be buried in a decent and respectable manner and as touching such worldly substance which God has been pleased to bless me with I give and dispose of them in the form and manner following

That is to say after my funeral Expenses and Just debts are discharged In the place I will that all my personal property be sold I also will that all my land after Jacob Rowley Jr my son's one hundred acres be surveyed off be sold as soon as it will sell for sixteen hundred dollars or sooner if any said heirs or a majority of them shall think it to be to their advantage to sell and agree to sell the same

In the first place I give and bequeath unto my son Jacob Roley Three hundred fifty dollars and to the rest of my children that is to say Catherine Craft, Mary Rowley widow of Peter Rowley, Mary Lawry, Joseph Rowley, Samuel Rowley, Margaret Houser, Israel Rowley and George Rowley share and share alike and I further will that Jacob Rowley Jr shall pay unto Mary Rowley widow of Peter Rowley the sum of sixteen dollars to be paid out of his three hundred and fifty dollars so soon as he shall receive it and I hereby appoint and constitute Jacob Rowley Jr. and Philip Hauser Executors of this my last will and testament whom I hereby authorize to sell my real estsate according to the above restrictions.

In witness whereof I have hereunto set my hand and seal this twenty eighth day of June in the year of our Lord one thousand eight hundred and forty seven.

Sallade the subscribing witnesses to the foregoing will who being sworn as the law directs depose and say that they were present and saw and heard Jacob Rowley senr. the Testator therein named sign seal publish pronounce and declare the foregoing instrument of writing as and for his last will and testament and that at the time of so doing he was of perfect and sound mind memory and understanding to the best of their knowledge observation and belief.

I, David C. Rowley of the village of Evansville, County of Rock, and State of Wisconsin, being mindful of the uncertainty of this life, do make and publish this my last Will and Testatment in manner and form following, to wit:

First - It is my will that my funeral expenses, and all my just debts be paid out of my personal estate by my Executrix hereinafter warned, as soon as may be after my decease.

Second- I give and bequeth unto my beloved wife Ann E. Rowley all my household furniture and wearing apparel to her own use and benefit forever-

And I also give bequeath and divise unto my said wife, Ann E. Rowley and her heirs and assigns forever, my homestead situated in the village of Evansville, County of Rock, State of Wisconsin, described as follows, to wit: The north one fourth of Lot No. ten(10)-and the whole of Lot No. eleven(11) in Block Fourteen(14) according to the recorded plot and survey of said village- and also a piece of land adjoining said premises on the North, described as follows: Beginning at the Northwest corner of said Lot Eleven(11) and run thence North on the East line of Madison Street, Two(2) Rods- thence East Eight (8) Rods- Thence South Two (2) Rods to the Northeast corner of said Lot Eleven(11)- Thence West on the North line of said Lot, Eight(8) Rods to the beginning.

Third- I give and devise unto my said wife Ann E. Rowley, and my son Elvin C.Rowley,and my daughter Nettie A. Rowley and their respective heirs and assigns forever- the following described piece of land situated in the town of Union, County of Rock, State of Wisconsin, and being part of the Southeast quarter of section No. Eight(8)Town Four, Range Ten, to wit: Beginning at the Southwest corner of said Lot, and run thence East Forty Rods - thence North Eighty Rods(80) -Thence West Forty(40)- Thence South Eighty(80) Rods to the place of beginning; And all other Real Estate which I may own at my decease, however described or wherever situated in equal shares-

Fourth- All the rest residue and remainder of my Estate, Moneys, Credits, and effects of whatever kind of nature, I give, bequeath and divise unto my said wife, and my said two children above named, in equal shares- subject however to the payment of my just debts and funeral expense, and the advertisement of my estate-

Fifth- And lastly I hereby nominate and appoint my said wife Ann E. Rowley Sole Executrix of this my last Will and Testament, hereby revoking all former will by me made-

In witness whereof I have hereunto set my hand and seal this 11th day of September A.D.1886-

In the name of God, Amen I, Shubal Rowley of the town of Warwick in the County of Orange and state of New York farmer being weak in body, but of sound disposing mind and memory and knowing that it is appointed for all men to die, do make and ordain this my last will and testament in manner and form following, viz. 1st I recommend my soul to that God who gave it and my body to the grave to be buried at the direction of my executors in decent Christian burial and as touching my worldly estate which God has been pleased to give me I dispose of it in manner and form following, viz. --

I give and bequeath unto my beloved wife, Joanna, the full use of the house in which I now live together with all the household furniture, loom and tackling with all the implements, thereunto belonging, one side saddle, one horse, one cow, and six sheep; the house, cow and sheep to be kept by my son Jonathan during her natural life or widowhood and all the above premises to be at her disposal except the house and horse which my son Jonathan is to have at her decease or marriage. I give and bequeath unto my son Jonathan Rowlee all my lands and tenements together with all my other buildings, horses oxen, cows, young cattle, sheep, hogs and all implements of farming movable and unmovable now to me belonging. But if any person or persons should dispossess my widow of the house I now leave to her use then my son Jonathan is obliged by this will to furnish his said mother with a comfortable house to live in and fire wood sufficient so long as she remain my widow.

And lastly I do ordain constitute and appoint Jonathan Rowlee and Francis Armstrong, Sr., Executors of this my last will and testament and I do utterly disannul and make void all former wills by me made declaring this and this only to be my last will and testament. In testamony hereof I have here unto set my hand and seat this 21st day of May in the year of our Lord one thousand seven hundred and ninety-five.

SHUBELL ROWLEE

Shubel Rowlee mentions only his widow and son Jonathan in his will, but there are reasons for believing that he had at least another son, Shubel Rowlee of Wells, Pa. The LATTER'S father's name was Shubel, and he was born in 1765 and migrated from Orange County to Bradford County, PA,, about 1800.
