WILL OF DANIEL ROWLEY

Proved February 9, 1807

The People of the State of New York by the Grace of God free and independent to all to whom these presents shall come or may concern send greeting. Know ye that at the town of Ballestown in this County of Saratoga on the ninth day of February in the year of our Lord one Thousand Eight hundred and seven before Henry Walton Esquire, Surrogate of our said County, the last will and testament of Daniel Rowley...Deceased( a copy whereof is hereto annexed) was proved and is now approved and allowed by us and the said deceased having whilst he lived and at the time of his death goods, chattels or credits within this state by means whereof the proving and registering the said will and the granting administration of all and singular the said goods, chattels and credits and also the auditing allowing and final discharging the account thereof doth belong unto us the administration of all and singular goods, chattels and credits of the said deceased and any way concerning his will is granted unto Noah Sweet, executor in the said will named. He being first duly sworn well and faithfully to administer the same and to make and exhibit a true and perfect inventory of all and singular the said goods, chattels, credits and also to render a just and true account thereof when thereunto required. In testimony whereof we have caused the seal of office of ourf said Surrogate to be hereunto affixed. Witness Henry Walton, Esquire, Surrogate of the said County at Ballstown aforesaid the ninth day of February in the year of our Lord one Thousand eight Hundred and seven and of our independence the 31st.

Daniel Rowley Will

written January 26, 1807

January 26, 1807 Know all you to whom it may concern that Daniel Rowley in the name of God in my last will and testament do bequeth and will to my beloved wife, Elizabeth Rowley all my real and personal property until my children come to the age of twenty one and my said wife bring my children up to the age of twenty one at her disposal and my household furniture be my wifes to her natural life’s end and then to go to my two daughters, equally divided to them both. I further do will and bequeth to my son, Noah S. Rowley the one half of my real and personal property except my household furniture before mentioned. Further more my son, Noah S. Rowley must maintain my Daughter Esther until she marries if she should. My Daughter Esther is to take her dowrey to her own disposal when married. Further I bequeth and will to my two daughters Esther Rowley & Polly Miriah Rowley the one half of my property before mentioned. I further appoint and ordain Noah Sweet to be my ownley exeter.

Saratoga County ss..Be it remembered that on the ninth day of February in the year of our Lord one Thousand eight Hundred and seven personally appeared before one Henry Walton, Esquire, Surrogate of the County of Saratoga, Ephraim Wheeler and Alexander S. Platt two of the subscribing witnesses to the above written will who being duly sworn on their respective oaths declared that they saw Daniel Rowley sign this above instrument in writting purporting to be the last will and testament of him the said Daniel Rowley thast they heard him publish and declare the same as and for his last will testament and that at the time the said Daniel Rowley was of sound mind, memory and understanding to the best of their knowledge and belief and that the names of the said Ephraim Wheeler and Alexander S. Platt subscribed to the said will are of there own respective handwriting and that they subscribed their names to the said will as witness in the presence of the executor and that Job Pratt the other subscribing witness to the said will subscribed his name thereto as a witness in the presence of the them and that Noah Sweet, the Executor in the said will named likewise appeared before me and was duly sworn to the faithful performance and execution of the said will.
